CHAPTER 10: AMENDMENTS

Section 1: General: The provisions of this chapter shall apply to applications for amendments to the Boundary County Zoning Map or any supplemental zoning map which changes the zone district designation of any particular property or which realigns or changes the boundaries of any zone district; and to applications for amendment to the text of the Boundary County Zoning and Subdivision Ordinance.

Section 2: Eligibility of Applicants: The following persons may make application for amendment to the Boundary County zoning map or any supplemental zoning maps adopted by Boundary County:
    A. The owner or owners agent of any parcel of land located within Boundary County. Owners of adjacent or contiguous parcels of land may make single application for all such parcels.
    B. The planning and zoning commission may initiate amendments of the zoning map for any lands located within Boundary County for the purpose of bringing the zoning map into conformance with the Boundary County Comprehensive Plan.
    C. The board of county commissioners may initiate amendments of the zoning map in response to a request or petition brought by affected persons.
    D. Any resident or owner of property located in Boundary County , the planning and zoning commission or the board of county commissioners may make application for amendment to the text of the Zoning and Subdivision Ordinance.

Section 3: Applications for Amendment to Zoning Maps:
    A. Applications for amendments to Boundary County zoning maps shall be made on forms supplied by the zoning administrator. Applications shall contain:
        1. The name, address and telephone number of the applicant. If the applicant is not the property owner, a statement signed by the property owner granting the applicant permission to proceed shall be included, unless the application is made by the planning and zoning commission or the board of county commissioners.
        2. A legal description of the property.
        3. The current zone district designation of the property and the zone district designation sought.
        4. The current zone district designation of adjacent and surrounding land.
        5. The reasons for the request.
        6. An application fee as established at Chapter 17.

Section 4. Applications for Amendments to Zoning and Subdivision Ordinance: Applications for amendments to the Zoning and Subdivision Ordinance shall be made on forms supplied by the zoning administrator and shall contain: The name, address and telephone number of the applicant; the purpose of the proposed amendment; the text of the proposed amendment or specific sections or provisions proposed for repeal.

Section 5: Standards:
    A. Approval or denial of applications for amendment of the zoning map or supplemental zoning maps shall be based on the following standards:
        1. The nature of the proposed change is in compliance with the Boundary County Comprehensive Plan.
        2. The nature of the proposed change is compatible with surrounding zone district designations and/or uses.
        3. The extent and nature of the impact such amendment would have on the delivery of public services, including school districts.

    B. Approval of any application to amend the text of the Zoning and Subdivision Ordinance shall be based on the following standards:
        1. The amendment is in compliance with the Boundary County Comprehensive Plan.
        2. The amendment will not result in increased costs to the public.
        3. The amendment will not infringe upon established property rights and uses.
        4. The amendment is in conformance with the requirements of Idaho Code.

Section 6: Procedure
    A. Upon receipt of a completed application for amendment, the zoning administrator shall schedule a public hearing on the next available agenda of the planning and zoning commission, allowing for public notification established at Chapter 16.
    B. The commission shall conduct public hearing on the application in accordance with the procedures established at Chapter 16.
    C. Following completion of the public hearing, the commission may:
        1. Forward the application to the board of county commissioners with a recommendation of approval.
        2. Forward the application to the board of county commissioners with a recommendation of disapproval.
        3. Table the application pending receipt of additional information or an amended application.
    D. Once a recommendation is received from the planning and zoning commission, the board of county commissioners shall schedule a public hearing on their next available regular meeting agenda, allowing for public notification established at Chapter 16. Following the public hearing, the board may:
        1. Approve the application.
        2. Deny the application.
        3. Table the application pending receipt of additional information or an amended application. 
    E. If an amendment to the official zoning map or supplemental map is approved, the zoning administrator shall cause the amendment to be promptly entered upon such maps in accordance with Chapter 5, Section 2.
