CHAPTER 3: ADMINISTRATION OF THIS ORDINANCE

Section 1: Establishment of the Planning and Zoning Commission
A. There is hereby established the Boundary County Planning and Zoning Commission, hereafter referred to as "commission," whose purpose is to carry out such planning functions as specified in Title 67, Chapter 65, Idaho Code, and other such duties as established by this ordinance. The planning and zoning commission shall consist of nine (9) members, who shall serve without compensation except for the reimbursement of expenses specifically authorized by the board of county commissioners.
B. Commission members shall be appointed by resolution of the board of county commissioners and shall meet the residency requirements established at 67-6504, Idaho Code. The resolution shall specify the effective date of the appointment and the date of expiration of the term of appointment. Terms will be staggered so no more than five (5) terms expire within any two (2) year period.
C. The term of office for members appointed to the commission shall be four (4) years. No appointed member shall serve more than two (2) full, consecutive terms.
D. The remainder of terms vacated prior to conclusion shall be filled by resolution of the Board of County Commissioners.
E. The commission shall meet regularly on the third Thursday of each month and at such other times necessary to conduct the business of the commission. All meetings will be held in conformance with the provisions of the open meeting law set forth at 63-2347 and 63-2341, Idaho Code.
F. Three or more absences from regular meetings during any consecutive twelve (12) month period may constitute cause for removal or a member of the commission by majority vote of the Board of County Commissioners.

Section 2: Powers and Duties of the Planning and Zoning Commission
A. The planning and zoning commission has the duty to conduct the comprehensive planning process for Boundary County, Idaho, in conformance with the provisions of 67-6507 and 67-6508, Idaho Code.
B. The commission will make recommendations to the board of county commissioners pertaining to the adoption or amendment of the Boundary County Comprehensive Plan; for the establishment of zone district boundaries, on applications for special use permits, preliminary plats and subdivisions which do not qualify for short plats; for amendments to land use ordinances, and on area of impact agreements with incorporated cities within Boundary County.
C. The commission will make final decisions, subject to appeal to the board of county commissioners as specified at Chapter 11 of this ordinance; on preliminary plats for subdivisions which qualify for short plat procedures, lot line adjustments, applications for variance, applications for conditional use permits and commercial/industrial site plans.

Section 3: Powers and Duties of the Board of County Commissioners
A. The board of county commissioners, hereinafter referred to as "board," will hear and decide appeals to any final determination or decision on applications rendered by the planning and zoning commission or the zoning administrator as set forth in Chapter 11 of this ordinance.
B. The board will make final decisions on the adoption or amendment of the Boundary County Comprehensive Plan, on the establishment of zone district boundaries, on special use permits, on preliminary plats for subdivisions excepting those which quality for short plat procedures, for amendments to land use ordinances and on Area of Impact agreements with incorporated cities within Boundary County.
C. The board will exercise any incidental powers necessary for the administration, enforcement and amendment of this ordinance.

Section 4: Establishment of the Office of Zoning Administrator
A. There is hereby established the office of zoning administrator, hereafter referred to as "administrator," who shall be appointed by the board of county commissioners.
B. The office of the administrator shall fall within and be included in the broader office of resource planner, which shall encompass other duties as specified by the board.
C. The administrator shall serve as ex-officio clerk of the planning and zoning commission and will oversee the keeping of records on all matters coming before the commission for consideration or action.
D. The administrator will receive and process all applications for permits required by this ordinance and perform all administrative duties necessary to carry out the provisions of this ordinance and actions pertinent to this ordinance made by the board and commission.

Section 5: Concurrent Processing of Applications: Whenever application is made for more than one (1) permit required by this ordinance, said applications will, to the extent possible, be submitted and processed simultaneously.
