MINUTES

July 17, 2003

Members present: Mary Ann Luedtke, Jane Kirby, Marc Paulson, Rod Barcklay, Jim Paulus, Jacob Epstein, Toby Schnuerle, Doug Reoch.

1. Chairman Paulus called the meeting to order at 5:30 p.m. for reading of the June minutes. Jane stated that the portion of the minutes concerning ownership and transfer of a home business occupation permit had not been included in the draft proposal of AM 03-02. Marc Paulson noted that Donna Standley’s name had been omitted from the minutes of the recent workshop. After discussion, Paulson made motion to waive reading and approve the minutes as amended. Kirby seconded and the motion carried unanimously.

2. Paulus called for personnel discussion and Schnuerle made motion, pursuant to Idaho Code 67-2345, to go into executive session to discuss a personnel matter. Kirby seconded and the motion carried. Following executive session, Schnuerle made motion to recommend to the Board of County Commissioners that member Jacob Epstein be removed for cause. Reoch and Barcklay abstained. Schnuerle, Luedtke and Kirby voted aye, Paulson and Epstein nay and the motion carried.

3. Paulus called for discussion of AM 03-02. Paulus stated that in his reading, he felt that the proposal looked good. Kirby noted the provisions for ownership and transfer of home business occupation permits. Epstein discussed requiring zoning certificates to be posted at construction sites and that contractors be required to ensure the permit is posted prior to working on the home. Reoch stated he felt the original proposal requiring a permit prior to electrical connection. Schnuerle said he preferred the commissioners’ proposal as it doesn’t place a burden on construction workers or utility providers, and he stated that utility providers could meet the written notification requirement by providing utilities with zone certificate applications to be included with their application packets. After discussion, it was agreed to retain the commissioners’ recommendation and to provide utility providers with county zoning certificate applications. Epstein discussed the mediation provisions and questioned whether a time limit should be set; after discussion, it was agreed that the proposal as written meets the objectives of mediation as it allows the applicant the flexibility of entering into mediation or proceeding with a hearing process. There being no further discussion, Paulson moved to approve AM 03-02 as amended and to set public hearing before the Planning and Zoning Commission August 21. Schnuerle seconded and the motion carried unanimously.

4. Under old/unscheduled business, Paulson stated he would not be available at the August or September meeting as he would be in Boise. Epstien raised questions about an RV park at the Mission Creek Store; staff stated he had discussed the park with the owner, and said that because the park is only to provide temporary space for construction workers on the highway project and was not a permanent facility, no permit process was necessary. Discussion was held on the provisions of two recent permits granted wherein the use appears to exceed the provisions of the application; staff stated he would look into both cases and inform the applicants if it appears a violation exists.

5. There being no further business, Luedtke made motion to adjourn, Reoch seconded and the motion carried unanimously. The meeting adjourned at 6:45 p.m.
