NOTICE OF PUBLIC HEARING

Boundary County Commissioners will hold public hearing at 9:30 p.m. Monday, August 30, 2010, in commission chambers at the Boundary County Courthouse to accept public comment on application 10-035 by Larry and Martha McNutt, who are seeking a zone map amendment on parcel RP62N02E171810A.

That 8.25-acre parcel, located at 15 Bent Twig Lane, is currently zone rural residential, which allows residential use on parcels not less than one acre in size. The applicant is seeking to have the zoning amended to rural community/commercial, which would allow commercial or residential use on parcels not less than one-quarter acre in size, so as to take advantage of Highway 2 frontage for commercial and multi-family residential development. The planning and zoning commission has recommended the application be approved.

The deadline for written comment and material is 5 p.m. Thursday, Thursday, August 26, 2010. Written comment may be mailed to Boundary County Planning and Zoning, PO Box 419, Bonners Ferry, ID 83805, faxed to (208) 267-1205, or emailed to planning@boundarycountyid.org. Written comment will be accepted at public hearing provided the material is read into the record. There may be a five (5) minute limit per person on verbal testimony.

DECISION/MOTION: Motion to recommend that the application be approved as presented made by member Paul Shelton, seconded by member Marciavee Cossette and carried unanimously.

OVERVIEW: The applicant is seeking to amend the zoning on 8.25-acre parcel RP62N02E171810A from Rural Residential to Rural Community/Commercial to allow commercial development along highway frontage and multi-family residential development.

SURROUNDING USES: Agricultural to the north, large lot residential to the south and west, state gravel pit to the east.

PUBLIC NOTIFICATION: Legal notice for planning and zoning public hearing July 15, 2010, published in Bonners Ferry Herald July 1, 2010. Notices mailed to surrounding property owners June 25. Property posted April 9. In addition to eleven surrounding property owners, notices were also sent to Three Mile Water, City of Moyie Springs, County Road & Bridge, ITD, Panhandle Health and Northern Lights.

WRITTEN COMMENT RECEIVED: Advisory letter from ITD regarding highway upgrades.

FINDINGS: In considering this application, the Boundary County Planning and Zoning Commission did find:
1. The nature of the proposed amendment is in compliance with the Boundary County Comprehensive Plan.
2. The nature of the proposed amendment is compatible with surrounding zone district designations and uses.
3. Approval of this amendment will not materially detrimental to the public welfare nor injurious to property or improvements in the vicinity, nor will it have adverse impact on the delivery of public services.
