DECISION/MOTION: Motion to approve the application as presented made by member Matt Cossalman, seconded by member Dan Studer and carried unanimously.
OVERVIEW: The applicant is seeking a variance to divide 20-acre parcel RP60N02W168710A into parcels approximately 9.75 and 13.25 acres in size where divided by the Pack River.
SURROUNDING USES: Forest, large lot residential, recreational.
PUBLIC NOTIFICATION: Legal notice for planning and zoning public hearing March 18, 2010, published in Bonners Ferry Herald February 25, 2010. Notices mailed to surrounding property owners February 25. Property posted March 10. In addition to three surrounding property owners, notices were also sent to the Idaho Department of Lands, the US Forest Service, Boundary County Road and Bridge, Panhandle Health.

P&Z PUBLIC HEARING: Initial public hearing March 18 tabled due to lack of quorum; hearing held April 15, 2010 with five members present.

FINDINGS: In
considering this application, the Boundary County Planning and Zoning Commission
did find:
1.The parcel is naturally divided by the Pack River, which afforded
no common access between those portions of the same parcel located on each side
of the river.
2.Access to the portion of the parcel on the west side of the
river is by driveway off Upper Pack River Road. Access to that portion of the
parcel on the east side of the river is by Twilight Lane, which turns off Upper
Pack River Road approximately ½ to ¾ mile north of the subject parcel, crosses
the river by bridge, and returns south along the east side of the Pack
River.
3.The division of this property by the Pack River makes the property
unsuited for uses established in the agriculture/forestry zone
district.
4.Based on the above, the variance requested does not constitute a
grant of special privilege inconsistent with limitations placed on similarly
situated properties within the agriculture/forestry zone district.
5.Approval
of this variance is not materially detrimental to the public welfare nor
injurious to property or improvements in the vicinity.
