The
Boundary County Planning and Zoning Commission will hold public hearing at 5:30
p.m. Thursday, July 17, 2008, in the Main Courtroom at the Boundary County
Courthouse to accept public comment on application 0808-087 by Charles and
Corrine Spence, seeking a zone map amendment on two parcels to allow expansion
of an existing storage facility.
Specifically, the applicants is to rezone adjoining parcels RP62N01E346640A and RP62N01E346631A, located on Tamarack Lane and the site of B&D Mini Storage, from residential to rural community/commercial.
The deadline for written comment and material is 5 p.m. Thursday, July 10a, 2008. Written comment will be accepted at public hearing provided the material is read into the record. There may be a five (5) minute limit per person on verbal testimony.

Purpose: The applicants are seeking to amend zoning to rural community/commercial so as to allow expansion of an existing business.
Surrounding Uses: North and East: Bonners Ferry High School and Middle School. South: Open field. West: Mobile home park, small-lot residential.
In considering this application, the Planning and Zoning must determine the following:
Residential Zoning: Purpose: To allow for residential uses within incorporated areas of impact. In the Bonners Ferry area of impact, there is no minimum parcel size.
Permitted uses include single family or duplex residential structures, home based businesses and zero lot line residences. Public and private parks and open space recreational facilities may be considered as conditional uses; any use not previously specified can be considered as a special use.
Rural Community/Commercial Zoning: Purpose: To allow a mixture of residential or commercial uses in population centers within Boundary County in conformance with the Boundary County Comprehensive Plan.
Permitted uses include one single family or duplex residential structure on lots not less than ¼-acre in size, public and private parks; home based businesses, commercial uses and public service facilities. Any use not specified may be considered as a special use.
In considering the Comprehensive Plan, the Planning and Zoning Commission must determine:
I. Private property rights: Does the proposed action enhance the owner’s right to enjoy the use of their property in pursuit of their own best interests, without undue interference on the rights of neighboring property owners to enjoy the same? Yes ___ No ___
II. Population: Not applicable as the proposed action does not impact population trends.
III. Economic: Does the proposed action promote economic development, maintaining and enhancing the economic condition of Boundary County by encouraging enterprise? Yes ___ No ___
IV. Land Use: Does the proposed action encourage the formation of enterprises that add value to the existing economic base, without adversely affecting the uses of surrounding land or impacting the flow of traffic? Yes ___ No ___
V. Natural Resources: Not applicable as none of the resources cited are impacted by this proposal.
VI. Hazardous Areas: Not applicable as this action does not lie within a defined hazardous area. Fire protection is provided by the Paradise Valley Fire Association.
VII. Public Services, Facilities and Utilities: The property proposed for amendment is currently served with water, sewer, electricity, gas and telephone.
VIII. Transportation: The property has frontage on U.S. 95 and an existing residential access.
IX. Recreation: Not applicable as the action does not affect any area commonly used for recreation.
X. Community Design: Does the proposed action insure the best possible use of the land and encourage free enterprise and the initiative of property owners? Yes ___ No ___.
