NOTICE OF PUBLIC HEARING

Boundary County Commissioners will hold public hearing at 1:30 p.m. Monday, June 16, 2008, in commission chambers at the Boundary County Courthouse to accept public comment on application 08-051 by Edward Alvarado, who is seeking a special use permit to establish and operate Reliable Storage on a 4.7-acre parcel on U.S. 95 just south of Camp Nine Road.

Specifically, the applicant is seeking to build, in stages, a storage facility of up to 10 buildings housing up to 110 individual storage units. Access to the units would be off-highway via private drive, and an estimated 20 vehicles per day would use the facility. The facility would be fenced with lockable gate, and be open from 8 a.m. to 5 p.m. in the winter and from 8 a.m. to 8 p.m. in the summer. The facility manager would maintain a residence on-site. The planning and zoning commission has forwarded a recommendation that the application be denied.

The deadline for written comment and material is 5 p.m. Thursday, June12, 2008. Written comment will be accepted at public hearing provided the material is read into the record. There may be a five (5) minute limit per person on verbal testimony.

Consideration: Consideration of this application as a special use is made pursuant to Chapter 7, Section 2E, Boundary County Zoning and Subdivision Ordinance.

In considering this application, the Planning and Zoning Commission must determine:

  1. That the site plan and other documentation provide sufficient detail as to provide a clear description of the proposed use.
  2. That there is sufficient land area to accommodate the proposed use and that structures are arranged so as to minimize adverse affects on surrounding properties.
  3. That the proposed use will no have substantial adverse affects on adjacent properties.
  4. That adequate public services exist or will be built to accommodate the proposed use.

Upon conclusion of public hearing, the Planning and Zoning Commission may:

  1. Recommend approval of the application, establishing terms and conditions.
  2. Table the application pending receipt of additional information.
  3. Recommend disapproval of the application, providing reasons in writing and specifying what actions, if any, may be taken to obtain approval.

Motion and Recommendation: Upon conclusion of public hearing, the Planning and Zoning Commission, following motion made by member Doug Reoch, seconded by member Jake Negley and passed by a vote of six “aye” to one “nay,” forwards to county commissioners a recommendation that application 08-051 be disapproved for the reasons specified below, and recommends that the applicant provide drawings to depict the structure and style of the buildings proposed and plans sufficient to show access, setbacks, fencing, and other aspects with respect to surrounding properties and Highway 95 so as to present a clearer picture of the proposal.

  2. That there is sufficient land area to accommodate the proposed use, but that there was inadequate information to determine that structures would be arranged so as to minimize adverse affects on surrounding properties.
  3. That the information in the application was insufficient to assure that the proposed use would no have substantial adverse affects on adjacent properties.
  4. That public services exist that could accommodate the proposed use, but that there was insufficient data to assure that ingress and egress from U.S. 95 would be adequate to safely provide for the increased use.
